The Public Liability Act, 1991 offers immediate relief to people affected by accidents resulting from the handling of hazardous substance, based on ???No Fault Liability???, through insurance by owner who handle or control these substances.

    The Act states that every owner handling or controlling dangerous or hazardous substances should buy Public Liability (Act) Insurance.

    The Liberty General Insurance Public Liability Insurance policy prepares you well for mishaps in the future. The policy provides coverage against accidents resulting from the handling of hazardous substances as mentioned in the Public Liability Insurance Act, 1991.

  • Sum Insured

    Sum Insured

    The cover provided by the policy, comes with certain limits, which are:

    Any One Accident (AOA): Not less than the paid up capital of the insured, subject to a maximum Rs. 5 crore.

    Any One Year (AOY):??? Three times the ???Any One Accident??? limit, subject to a maximum of Rs. 15 crore.

    Claims exceeding the above statutory limits are to be met by the Environmental Relief Fund (ERF).

    Factors like gross annual turnover and limits of indemnity are considered before calculating the amount of premium paid by you.

Coverage

Anyone (company, association or firm) handling or controlling hazardous substances as mentioned in the Public Liability Insurance Act 1991 and the rules framed thereunder is eligible to purchase Public Liability (Act) Insurance.

The statutory liability of the insured resulting from accidents taking place during the currency of the policy because of the handling of hazardous substances as mentioned in the Public Liability Insurance 1991 and the rules outlined under the same.

This Public Liability Insurance (Industrial Risk) policy will not cover any liability assumed by you, the insured, through any agreement and which would not have attached without such an agreement. The policy won???t cover you in the following cases:

  • Arising out of wilful or intentional non-compliance of any statutory provisions
  • In respect of damage to property owned, leased or hired or under hire purchase or on loan to the Insured or otherwise in the Insured Owner's control, care or custody.
  • In respect of fines, penalties, punitive and/or exemplary damages.
  • Arising under any other legislation except in so for as provided for in Section 8 sub sections (1) and (2) of the Act.
  • Directly or indirectly, occasioned by, happening through or in consequence of war, invasion, act of foreign enemy, hostilities (whether war be declared or not), civil war, rebellion, revolution, insurrection or military or usurped power.
  • Directly or indirectly caused by or arising from or in consequence of or attributable to any act of terrorism.
  • Directly or indirectly caused by or contributed to by
    • Ionising radiation or contamination by radioactivity from any nuclear fuel or from any nuclear waste from the combustion of nuclear fuel.
    • The radioactive, toxic, explosive or other hazardous properties of any explosive nuclear assembly or nuclear component thereof.
